O novo período, denominado por Milton Santos (1994) de Técnico-Científico-Informacional, no que diz respeito ao processo de urbanização, consagra, dentre outras coisas, uma redistribuição das classes sociais no território, sendo as cidades as áreas mais aptas a acolher a população de baixa renda. Nos últimos anos, as atividades antrópicas, mormente nas áreas de ocupação desordenada do espaço urbano das grandes cidades, têm contribuído para a ocorrência de alterações nas bacias de drenagem e seus canais constituintes. Numa escala relativamente curta de tempo, é possível perceber transformações significativas nas áreas de várzeas urbanas ocupadas. De modo que os estudos referentes aos impactos das atividades antrópicas sobre as redes de drenagem urbanas têm sido cada vez mais necessários, uma vez que tais impactos têm produzido uma série de problemas ao meio ambiente afetando, inclusive, o bem-estar da própria população. O estudo pretende desenvolver uma breve análise no campo jurídico sobre a ocupação dessas áreas no contexto do Direito à Cidade, notadamente como essas localidades são tratadas pelos Planos Diretores (PD), destacando os municípios de Duque de Caxias, de São João de Meriti, de Belford Roxo e de Mesquita, pertencentes à Baixada Fluminense, Região Metropolitana do Rio de Janeiro (RMRJ), em território brasileiro; e como a Sentença Mendoza cuida da situação da Bacia Matanza-Riachuelo, Área Metropolitana de Buenos Aires (AMBA), em território Argentino. Destacando, sobretudo como tais instrumentos jurídicos trabalham com a questão da ocupação irregular das áreas marginais.


The new period, called by Milton Santos (1994) Technical-Scientific-Informational, with regard to the urbanization process, establishes, among other things, a redistribution of social classes in the territory, and the cities the most suitable areas to host the low-income population. In recent years, human activities, especially in the areas of disorderly occupation of urban areas of large cities, have contributed to the occurrence of changes in watersheds and their constituents channels. In a relatively short time scale, you can see significant changes in the areas of occupied urban floodplains. So the studies on the impacts of human activities on urban drainage systems have been increasingly necessary, since such impacts have produced a number of problems affecting the environment, including the welfare of the population itself. The study aims to develop a brief analysis on the legal field on the occupation of these areas in the context of the Right to the City, especially as these locations are handled by Master Plans (PD), highlighting the cities of Duque de Caxias, in St. Johns Wood, of Belford Roxo and mosque belonging to the Baixada Fluminense, the metropolitan area of Rio de Janeiro (RMRJ) in Brazil; and how the judgment Mendoza takes care of the situation of the Matanza-Riachuelo Basin, Metropolitan Area of Buenos Aires (AMBA) in Argentine territory. Highlighting, especially as such legal instruments work with the issue of illegal occupation of marginal areas.
